OUR FIRM

Nielsen, Broman & Koch P.L.L.C. is an AV rated (highest levels of skill and integrity) criminal and civil appellate law firm in Seattle, Washington. Founded by Eric Nielsen in 1994, NBK is one of Washington's finest appeals firms. Our attorneys have litigated over one thousand cases in all divisions of the Washington State Court of Appeals, the Washington State Supreme Court, and the Ninth Circuit Court of Appeals. NBK attorneys have been lead counsel in over 60 Washington Supreme Court cases. All our partners are members of the Washington Appellate Lawyers Association and Washington Law & Politics magazine has recognized Eric Broman and David Koch as among the best appellate attorneys in Washington State.

Shortly after NBK was founded, the State of Washington awarded our firm a contract to represent indigent criminal appellants in the Washington courts of appeal. We continue in that role and also regularly represent non-indigent criminal appellants. Two of our firm's partners -- Eric Nielsen and Eric Broman -- are qualified under the Washington State Supreme Court's rigorous standards to handle death penalty appeals. Both have obtained a reversal of a death penalty conviction in the Washington Supreme Court.

We also represent civil appellants. Our attorneys have handled appeals in land use, landlord/tenant, torts, employment, family law, Indian law and medical malpractice cases. We have also appeared as amicus curiae on a broad range of legal issues.

SERVICES

We provide a wide range of affordable, quality appellate services with a flexible pricing structure, including hourly billing or a flat fee for services basis.

Consulting

A successful appeal begins at trial. And an adequate trial record is often the most important factor in a successful appeal. We are available to consult with clients and trial counsel in planning strategies, and preserving issues for appeal in the event an appeal is necessary. In this role, we can also assist trial counsel in preparing dispositive pre-trial motions, trial briefs, special jury instructions, and post-trial motions.

Association

We understand that clients often have strong, trusting relationships with their trial attorneys and are reluctant to turn their case over to an appeals attorney whom they do not know. We also recognize that many good trial attorneys have limited appellate experience. We are available to associate with counsel either immediately after trial or when the record is perfected. We evaluate the case and provide an objective assessment of the likelihood of success on appeal. If the appeal has merit and the client elects to proceed, we can consult with trial counsel on the factual and legal issues, prepare all necessary briefs, and present oral argument.

Representation

We also accept referrals from trial counsel; or clients may retain us directly. We will litigate an appeal from the initial filing of the Notice of Appeal to its conclusion. We assess the merits of the appeal, advise the client, prepare all necessary briefs and motions, present oral argument, and seek further relief as necessary. In short, we are a full service appeals firm ready to litigate every aspect an appeal from start to finish.
